Commission Form
Terms and Conditions:
By purchasing a commission from me, you must agree to the terms and conditions laid out below:
Please read the terms carefully:
PAYMENT AND PROCESS:

Prices are subject to change based on demand.

Currency accepted in USD and through Square Invoice ONLY
-
Commissions 50% upfront and 50% after final approval.

To request a commission, fill out this form. I will reach out via email to discuss commission details.

It is advised that you provide a reference of characters (and background if its a fancy background)

If you do not provide reference, I will charge for Character design. (See Pricing Chart)

Once details are agreed upon I will provide a quick thumbnail sketch for you to approve. (For animations, a quick animated sketch will be shown.)

Once commission details have been agreed upon and approved, I will send you a Square Invoice Estimate (once I am ready to start on your piece) (based on how many hours I think it will take me to finish the commission) of which you will pay 50% of upfront .

Once 50% upfront payment has been received, I will notify you that I am starting on your commission

If anything comes up that will slow the progress of the initially estimated delivery time I will let you know ASAP.

Refunds will only be offered if something happens on my end that results in me not being able to finish the commission.

I will provide at least 3 (or more if it is a very complex piece) check ins all of which you will need to approve (all watermarked):

One at "Line Art" Stage

One at "Colored Flats" Stage

One at "Complete" Stage

You get 4 rounds of revisions on the commissioned piece included in the price:

2 revisions at the Line Art Stage (where you can change things regarding the lineart)

2 revisions at the Colored Flats Stage (where you can only change things regarding the color)

If you have a problem with anything in regards to the commissioned piece please tell me right away!

A fee will be added if you want something changed on the final drawing
-
If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

Once you approve the commissioned piece at the "Complete" Stage (You will see the completed piece but with watermarks), I will send you a Full Square Invoice where you will pay the remaining balance.

Price on Invoice may vary from the Estimate if I took more or less time than estimate

Amount due at the "Complete" Stage will be:

The time it took for me to finish the piece x hourly wage minus the 50% of the estimate that was already paid upfront.

Example:
-
Estimate: $15/hr x 8 hours ($120)
-
You'd pay $60 up front (50% of $120)
-
If it took LESS time than Estimated (Example 6 hrs):

$15 x 6 = $90 on Invoice Total
-
$90 - $60 upfront payment is the payment that is due
-
In this example $30 will be due at the "Complete" stage
-
If it took MORE time than Estimated (Example 10 hrs):
-
$15 x 10 = $150 on Invoice Total
-
$150 - $60 upfront payment is the payment that is due
-
In this example $90 will be due at the "Complete" stage

Once payment has been paid in full, you will receive the non-watermarked full-resolution image.

Other image sizes can be given upon request

Note that there is no physical product.
GENERAL TERMS
I, Mitsuki Youko (the artist):
-
reserve the right to cancel and refund the order at any time for any reason.

Will retain all copyrights over the commissioned artwork.
-
Will retain the rights to the intellectual property (IP) of the commissioned artwork IF the character/concept was designed by me.
-
will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
-
reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.
-
have the right to reject any order that I do not feel comfortable drawing for any reason.
-
might record the drawing process and post it on my youtube
-
will include a signature that you may not remove in all of my commissions.
You (the customer/commissioner):
-
may NOT Claim the artwork as your own
-
may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.)
-
may NOT alter the commissioned artwork without my (the artist's) consent.
-
may NOT sell the artwork.
-
will retain the rights to the intellectual property (IP) of the references/concepts you provided.

may NOT use the commissioned artwork for commercial purposes. The license to the commissioned artwork may be purchased at any point - contact me for info.

may upload the commissioned artwork on any website and social channels.
MISC:
-
If you need something in a hurry, mention it in our email exchange. Rush fees may apply.

I am willing to change some of my terms for you (depending on what it is) if you ask before I start on your commission.

If you, e.g., do not want me to post your commissioned piece anywhere, we can discuss this.
